Polish Prime Minister Donald Tusk, in a national address delivered at 8:00 p.m. local time this evening, assessed the events that unfolded following the suspension yesterday evening of Constitutional Court Vice President Bogdan Swieczkowski and his deputy, Bartlomiej Sochanski, on the grounds that they had obstructed the Constitutional Court from carrying out its duties. Stating that they had witnessed shameful events in front of the Constitutional Court building last night but would not back down in the face of lawlessness and violence in order to maintain peace, Prime Minister Tusk said, “The attack on the Constitutional Court and its judges is is another stage in the process by the Law and Justice Party (PiS), former President Andrzej Duda, and current President Karol Nawrocki to dismantle the rule of law in Poland.”

He noted that, together with the parliamentary majority, he had made efforts to reform the Constitutional Court, and that neither international institutions, Polish legal authorities, and the public all agreed that the Constitutional Tribunal, as imposed by the main opposition party PiS, was not a genuine court. “We presented draft resolutions and legislative proposals to all political forces and both presidents that would enable us to jointly reestablish the rule of law. However, all of these efforts came to nothing; everything was blocked by the president and PiS,” he said.

He explained that they had calmly awaited the election of new judges by waiting for the terms of the previous members appointed by PiS to expire; that Parliament had made its selection; that the judges had taken their oaths; but in contrast, current President Nawrocki refused to accept these oaths,” Tusk said, adding that the judges—who had been elected in accordance with the law—were also blocked by Constitutional Court President Swieczkowski and were unable to assume their posts.

Tusk said, “A state governed by the rule of law differs from the law of the jungle in this respect: Right and wrong are not determined by brute force or rudeness. In a state governed by the rule of law, a judge—even if she is a woman of extremely delicate build—will not back down in the face of an aggressive, burly bully. In a state governed by the rule of law, no politician—not even the president—can enter the premises of the Constitutional Court or any other court to issue orders or threaten judges,” he said.

The Polish Prime Minister noted that there have been organizations and politicians in the country for years seeking to undermine democracy and the rule of law, adding that it is no coincidence that these circles find support among pro-Russian forces around the world. Tusk, noting that his duty as head of the executive branch is to ensure the security and working conditions of the Constitutional Court, added that he is determined to fulfill his duties.
